CH-Trailer Rentals – Trailer Rental Agreement and Equipment Disclosure

This Rental Agreement and Disclosure ("Agreement") is made between CH-Trailer Rentals ("Lessor") and the individual or entity renting the trailer ("Renter").

   Extensions must be requested and approved at least 24 hours prior to the original return time.

3. Rental Charges

       Heavy-Duty Safety Chains (Set): $20

4. Insurance and Liability
   All trailers are fully insured by CH-Trailer Rentals.
   Renter must carry valid insurance for the towing vehicle and provide proof prior to pickup.
   Renter is responsible for uninsured damage, theft, or any loss caused by improper use or negligence.

5. GPS System
   Trailers are equipped with a GPS tracking device.
   Purpose: GPS records mileage for maintenance scheduling and recovery if a trailer is missing or overdue. No personal tracking or location history monitoring is performed.

   Data Policy:
       Mileage data is used only for service intervals and securely deleted after use.

   Tampering Prohibition:
       Renter agrees not to tamper with, remove, disconnect, disable, or obstruct the GPS system.
       Violation may result in forfeiture of the security deposit and additional charges.

6. Condition of Trailer
   Trailer is provided clean, roadworthy, and fully functional.
   Renter agrees to inspect the trailer prior to taking possession.
   Trailer must be returned clean and free of debris; cleaning fees apply if needed.

6A. Trailer Release and Safety Inspection

   Before trailer pickup, the Renter must inspect and confirm that:
       All trailer lights (brake lights, turn signals, running lights) and electric brakes are fully operational.
       The towing vehicle is equipped with a working electric brake controller and a 7-way trailer plug.

   Renter must sign a Trailer Release Form confirming:
       Trailer lights and brakes are in working condition.
       Towing vehicle is properly equipped with an electric brake controller and 7-way plug.
       Acceptance of the trailer’s operational status at pickup.

   Any issues must be reported immediately before departure; otherwise, the trailer is deemed accepted "as-is."

7. Permitted Use
   Use only for lawful purposes within stated load limits.
   Loads must be properly secured using tie-downs, tire straps, and chains as required.
   No unauthorized border crossings without written permission.

8. Prohibited Uses
   No overloading beyond rated GVWR.
   No transport of hazardous or illegal materials.
   No unauthorized modifications or adjustments to trailer systems.
   No use of the trailer in or around saltwater environments.
       Exposure to saltwater causes expedited corrosion and damage to equipment. Any violation may result in forfeiture of deposit and additional repair charges.

9. Maintenance and Damage
   Renter must monitor tire pressure, lug nuts, trailer lights, and hitch connections during use.
   Minor maintenance during rental (such as re-tightening straps) is renter’s responsibility.
   Renter is responsible for any damage beyond normal wear and tear.

10. Return Conditions
   Trailer and all rented equipment must be returned clean, undamaged, and fully functional.
   Damage, lost equipment, or cleaning fees will be deducted from the security deposit.

11. Indemnification
   Renter agrees to indemnify, defend, and hold harmless CH-Trailer Rentals from any and all claims, damages, losses, and expenses arising out of the use or misuse of the trailer and equipment.

12. Governing Law
   This Agreement is governed by the laws of the State of Florida.

13. Tow Vehicle Responsibility
   Renter is solely responsible for ensuring that their towing vehicle is properly rated and equipped to tow the trailer’s Gross Vehicle Weight Rating (GVWR).
   CH-Trailer Rentals is not responsible for verifying the towing vehicle's suitability, equipment, or condition.
   Any towing-related failures, accidents, or damages caused by inadequate towing capacity are the sole responsibility of the renter.

Acknowledgment and Consent

By signing below, the Renter acknowledges:
   They have inspected and accepted the trailer in good working condition.
   They have confirmed their towing vehicle is properly equipped with a working brake controller and 7-way plug.
   They have been informed about and consent to the GPS system use for maintenance and recovery purposes only.
   They agree to abide by all terms and conditions of this Agreement.
